Summary

The coordination of settlement planning between litigators, probate attorneys and special needs planners ahead of a settlement is critical when serving clients who be under Guardianship and/or depend upon means-tested government benefits such as SSI, Medicaid, SNAP or subsidized housing. The attorneys must be on the same page as to their mutual clients benefits, the timing of the settlement, what Probate court orders may be necessary to facilitate a settlement for someone under Guardianship, as well as work together to set the clients expectations as to how special needs trusts must be managed.
