Some claims that should win, don’t win. Knowing why is the first step to knowing what, if anything, you can do about it. This program will look at the appeals process with an eye towards making a record that shows the administrative law judge did not act reasonably. The program will explore the burden of proof at the administrative level and the Standard of Review in the District Court, and identify some common issues the Court has addressed.

The presenters will cover the basic procedures in planning the small-to-medium estate. You will learn the pertinent questions you need to ask to establish estate planning objectives with your client and receive a sample checklist of those questions. They will review sample forms to use in the documents, including forms related to Credit Shelter Trusts, QTIP Trusts, and trusts for the benefit of minor children. They will also discuss peripheral documents, such as living trusts and various kinds of powers of attorney.
