The Rhode Island House and Senate passed and July 15, 2019, the Governor signed perhaps the most significant change in our tort law since the 1974 comparative negligence statute.

Forty-five (45) years later, that statute has been amended. The amendment abolishes open and obvious as a bar to recovery in premises liability cases, but makes it a factor in determining whether there is comparative negligence.

This program will discuss the legislative history of the bill, the change, effective date, impact on pending cases, case selection, settlements, trials, jury charge, and jury verdict forms.
